Alabama's cannabis market remains highly restricted, with no legal recreational use, delayed medical access, and new limits on hemp-derived THC products. Although medical cannabis was legalized in 2021 through the Darren Wesley "Ato" Hall Compassion Act, the program has yet to become operational due to ongoing legal challenges surrounding the licensing process. Patients with qualifying conditions such as PTSD and chronic pain still cannot access medical cannabis, and dispensaries remain unopened. Meanwhile, the state enacted a new law in July 2025 banning smokable hemp products and imposing strict regulations on consumables, including THC limits, lab testing, child-proof packaging, and a 10% excise tax, with oversight by the Alabama Alcoholic Beverage Control Board. Online sales, deliveries, and vending machine distribution are also prohibited. As a result, Alabama’s cannabis economy is in a holding pattern, with licensed operators awaiting clarity while the state navigates court rulings and regulatory delays that continue to stall progress.
